He was a quartermaster in the War of 1812 and a judge advocate. Hays and his siblings married into the Butler family, who were wards of Jackson, forming a close relationship. In the 1820s, Hays and his associates were founding settlers of Jackson, Tennessee, established after a treaty Jackson negotiated with the Chickasaw.
